Negotiating a Purchase

The Purchase Process
Promise of Sale
The promise of sale, also referred to as ‘Konvenju’ in Maltese is the first legal step towards securing the property. This is essentially a promise between the buyer and seller that the transaction is to be concluded within a certain timeframe.
Upon signing the preliminary agreement (konvenju), you will be asked to pay a portion of the tax due and a deposit on the property price, this is usually about 10% of the agreed price.
During the process, the Notary carries out the necessary searches to verify the legal title of the property. Apart from this, it is also ensured that there are no outstanding debts on the property or any hypothecs, etc.
The Contract
As soon as the necessary searches and checks are completed, a contract date is set. The contract is signed at the Notary’s office, or if the client is financing the property through a bank, at the bank’s premises.
Upon signing of the final deed, any pending balances will be settled.
